These Terms and Conditions apply to all purchases made through riverwoodcreative.com and any related sales channels (including Etsy). By completing a purchase, you confirm that you have read and agreed to these terms.

Riverwood Creative is operated by Simone Hervij, a sole proprietorship registered in the Netherlands (KvK: 52889122).

1. Definitions

1.1. Riverwood Creative / Simone Hervij: the sole proprietorship Simone Hervij, based in Hoofddorp, the Netherlands, registered with the Dutch Chamber of Commerce under number 52889122.

1.2. Customer: the individual or legal entity who purchases a product from Riverwood Creative.

1.3. Template: a digital Showit website template, including all associated files and materials delivered upon purchase.

1.4. Add-on: any additional digital product sold separately, such as extra pages or design elements.

1.5. Agreement: the agreement between Riverwood Creative and the customer, formed at the moment of completed purchase.

2. Applicability

2.1. These terms apply to all products offered, sold, and delivered by Riverwood Creative.

2.2. By completing a purchase, the customer confirms they have read and agreed to these terms.

2.3. If any provision of these terms is deemed invalid or unenforceable, all remaining provisions remain in full force.

2.4. Riverwood Creative reserves the right to amend these terms at any time. Updated terms will be published on the website and apply to all new purchases from the date of publication.

3. Products and Delivery

3.1. Riverwood Creative sells digital Showit website templates and related digital products.

3.2. All templates are designed for use with the Showit website platform. The customer is responsible for having a valid Showit subscription. Riverwood Creative is not affiliated with Showit and has no influence over Showit’s platform, pricing, or availability.

3.3. Upon successful payment, the customer will receive access to the purchased template via the email address provided at checkout. Delivery is immediate and automated.

3.4. Riverwood Creative makes every effort to ensure templates are delivered correctly. If you do not receive access within 24 hours, please contact simone@riverwoodcreative.com.

3.5. Templates are provided as-is at the time of purchase. While Riverwood Creative may release updates, there is no obligation to provide updates or new versions to existing customers.

4. License

4.1. Upon purchase, the customer receives a non-exclusive, non-transferable personal license to use the template.

4.2. This license permits:

• Use of the template for the customer’s own website.
• Use of the template for one client project (if the customer is a web designer or creative professional). Each client project requires a separate license purchase.
• Customisation of the template to suit the customer’s or their client’s brand and content.

4.3. This license does not permit:

• Reselling, redistributing, or sharing the template files with any third party.
• Using the template to create derivative templates or design products for sale.
• Claiming the template design as the customer’s own original work or presenting it as such.
• Using the template for more than one client project without purchasing an additional license.
• Sharing access to the template with team members, partners, or subcontractors who are not directly working on the licensed project.

4.4. Violation of these license terms may result in termination of the license without refund, and Riverwood Creative reserves the right to pursue legal remedies.

5. Support

5.1. Each template purchase includes 6 months of support on the functioning of the template itself. This support covers issues directly related to the template’s design and structure within Showit.

5.2. Support does not cover:

• General Showit platform questions (please contact Showit support directly).
• Issues resulting from customer modifications to the template.
• Third-party integrations, plugins, or tools.
• General web design or marketing advice.

5.3. Support requests can be submitted by email at simone@riverwoodcreative.com. Riverwood Creative aims to respond within 3 business days.

5.4. Support is provided in English only.

6. Payment

6.1. All prices are listed in USD. Payment is processed securely through the checkout at the time of purchase.

6.2. If a payment plan is offered and selected, the customer authorises Riverwood Creative and its payment processor to charge the agreed instalments automatically on the agreed dates.

6.3. If a payment plan instalment fails, access to the purchased product may be suspended until the outstanding amount is paid.

6.4. The customer is legally required to complete all remaining payments of a payment plan, regardless of whether the template is actively used.

6.5. Applicable taxes (such as VAT) may apply depending on the customer’s location and are the customer’s responsibility. Riverwood Creative is not responsible for local tax obligations of the customer.

7. Refund Policy

7.1. Due to the nature of digital products, all sales are final. No refunds are provided once the template has been delivered.

7.2. This applies to all purchases, including those made through payment plans. If a refund is requested under a payment plan, any remaining instalments are still due.

7.3. If the template is not delivered due to a technical error on our end, the customer is entitled to a full refund or redelivery.

8. Intellectual Property

8.1. All intellectual property rights in the templates and related materials remain with Simone Hervij / Riverwood Creative. Purchase of a template grants a license to use, not ownership.

8.2. The customer may not copy, redistribute, resell, or otherwise make available any part of the template to third parties beyond what is permitted under the license in Article 4.

8.3. Riverwood Creative reserves the right to showcase work created using its templates in its portfolio, on its website, and on social media, unless the customer explicitly requests otherwise in writing.

9. Liability

9.1. Riverwood Creative templates are provided for the customer’s own use and at the customer’s own risk. Riverwood Creative is not liable for any outcomes, results, or business performance resulting from the use of its templates.

9.2. Riverwood Creative is not responsible for any technical issues, downtime, or changes made by Showit to its platform that may affect the template’s appearance or functionality.

9.3. In any event, Riverwood Creative’s total liability is limited to the amount paid by the customer for the product in question.

9.4. Riverwood Creative is never liable for indirect or consequential damages, including but not limited to lost revenue, lost data, or missed business opportunities.

10. Governing Law

10.1. These terms are governed by Dutch law.

10.2. Any disputes arising from a purchase will be submitted to the competent court in the district where Simone Hervij is established, unless mandatory law provides otherwise.

10.3. Parties will first attempt to resolve any dispute in good faith before initiating legal proceedings.
